Overview

This website is operated by Lauzon Music, 1345 Wellington St. W, Ottawa, ON K1Y 3B8, Canada. Throughout the site, the terms "we", "us" and "our" refer to Lauzon Music.

By visiting our site or buying something from us, you agree to the terms below. They apply to every user of the site, including browsers, customers and contributors of content. Please read them. If you do not agree to them, do not use the site.

Our Shipping Policy, Return and Refund Policy and Privacy Policy form part of these terms.

We may update these terms. The current version is always the one posted on this page, and it is your responsibility to check it. Continuing to use the site after a change means you accept it.

Using this site

You must be the age of majority in your province, state or territory to buy from us, or have the consent of a parent or guardian.

You may not use our products or this site for any unlawful purpose, to violate anyone's rights, to transmit malicious code, to harvest personal information, or to interfere with the security of the site. We may end your access for breaching any of this.

You agree not to reproduce, copy, sell or exploit any part of the site or any product we sell without written permission from us.

Products, prices and availability

Most of what we sell is one instrument, one of a kind, in one place. Stock changes daily and an item can sell in the shop and online at the same time. If something you ordered is no longer available we will contact you and refund the order in full.

Prices are set in Canadian dollars. Customers shopping from the United States and other markets see prices converted to US dollars, and the converted figure shown at checkout is the amount that will be charged in that currency.

We do our best to display colours and images of our products accurately, but we cannot guarantee that your screen shows them correctly.

Prices and product descriptions can change without notice, and we may limit or discontinue a product at any time. We reserve the right to refuse or limit any order, including orders that appear to be placed by dealers or resellers.

Errors and inaccuracies

Occasionally information on the site contains a typographical error, an inaccuracy or an omission relating to a product description, price, specification, promotion or availability. We may correct any error and change or cancel an order placed on wrong information, including after you have submitted it. If we cancel an order for that reason we refund it in full.

Billing and account information

You agree to give us current, complete and accurate purchase and account information for every order, and to update it promptly so we can complete your order and reach you.

Shipping and delivery

Shipping rates, handling times, insurance, and how orders to the United States and overseas are handled are set out in our Shipping Policy. Risk of loss passes to you on delivery. Every shipment is insured for its full declared value.

Returns

Our Return and Refund Policy governs returns and exchanges. In short: 48 hours from the moment the instrument arrives, authorized by email before anything is sent back.

Custom orders and special orders

A minimum 25% deposit places a custom order, and it can vary by product. Once we have placed the order with the builder, the deposit is non-refundable and the order cannot be cancelled. A special order for a stock model can be cancelled within seven days of placing it. We confirm the spec and the terms with you in writing before anything goes to the builder.

Financing

Financing may be offered at checkout through a third-party provider. Any financing agreement is between you and that provider, governed by their own terms and conditions, and it is separate from your purchase from us. We are not the lender and we do not make credit decisions.

Third-party links and tools

The site may give you access to third-party materials and links to third-party sites. We are not responsible for their content or accuracy, and we do not warrant them. Any third-party tool is provided as-is, and using it is at your own risk. Read the third party's terms before you use it.

Comments and submissions

If you send us ideas, suggestions, reviews or other material, whether we asked for it or not, we may use, edit, copy and publish it without restriction and without any obligation to pay you or keep it confidential. You agree that anything you send is your own, is not unlawful or defamatory, and does not infringe anyone's rights.

Personal information

Personal information you give us through the site is governed by our Privacy Policy.

Disclaimer and limitation of liability

We do not guarantee that your use of the site will be uninterrupted, timely, secure or error-free. The site and the products we sell through it are provided as-is and as-available except where we say otherwise in writing.

To the fullest extent permitted by law, Lauzon Music and its owners, employees and suppliers are not liable for any indirect, incidental, punitive or consequential loss arising from your use of the site or any product bought through it. Where liability cannot be excluded by law, it is limited to the amount you paid for the order in question. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

Nothing in these terms affects a manufacturer's warranty on an instrument, where one applies.

Indemnification

You agree to indemnify and hold harmless Lauzon Music and its owners, employees and suppliers from any claim or demand, including reasonable legal fees, made by a third party because you breached these terms or the documents they incorporate, or because you violated a law or the rights of a third party.

Severability

If any part of these terms is found to be unlawful or unenforceable, that part is severed and the rest stays in force.

Termination

These terms are effective unless and until ended by you or by us. You may end them by ceasing to use the site. We may end them at any time if we believe you have failed to comply with them. Obligations incurred before termination survive it.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. The courts of Ontario have jurisdiction over any dispute arising from them.

Entire agreement

These terms, together with the policies posted on this site, are the entire agreement between you and us and replace any earlier agreement or understanding. Any ambiguity is not to be read against us as the drafter.
